PRIVACY POLICY

May 24, 2018

This Privacy Policy tells you about the privacy practices of WarWire, Inc.(referred to as “WarWire,” “Service,” “we,” “us,” or “our”). In it, you’ll find out the types of information that we gather from you, and the ways that we use and share this information.

Please read this Privacy Policy carefully—by visiting WarWire’s website, and using its services, you agree to be bound by the terms of this Privacy Policy, as well as our Terms of Service. All defined terms in the Privacy Policy shall have the same meaning as the terms defined in the Terms of Service. Of course, this policy only applies to WarWire’s website and WarWire’s Service. It does not apply to any external links from WarWire’s website, nor does it apply to any of the social-media platforms that WarWire connects, to, such Twitter, YouTube, and others. So, we encourage you to read the privacy policies of those services before using them, or before using WarWire.

As a principle, we’re committed to protecting your privacy. Aside from information used to set up your account (such as name, email, location, and credit-card information), and data relating to how you use the Service (search requests, for example), we don’t collect personal information.

WarWire’s Service only lets its users search for publicly available social-media information, which means that the authors of this information have already made it publicly available through the privacy settings of their own social-media accounts. Some searches using WarWire may therefore retrieve publicly available personal information. However, we neither store that information, nor do we scrape or mine social-media data. Finally, if a social-media service that WarWire connects to says we can’t search or gather publicly available information in a certain way (say, due to new privacy standards), then we will not do it.

Definitions

  1. “Non-Personal Information” is information that is in no way personally identifiable and that is obtained automatically through your simple use of our Website with a web browser, or through the use of the Service.

  2. “Personally Identifiable Information” is the information that you have provided to us in order to deliver a product or service to you. In other words, when you sign up to use WarWire, we’ll ask you for some information in order to set up your account, such as name, email address, and physical location. Once you’re signed up and have created an account, we’ll also redirect you to your personal social media account pages so that you can authorize WarWire to conduct searches for publicly available social media information on your behalf. In the next section, we’ll describe in greater detail what information we collect from you, and how and why we use it.

INFORMATION COLLECTED

When you visit our Website, we collect Non-Personal Information such as your browser type. We also collect personal information such as your IP address, which can be used to identify the computer that you are using, or to estimate your geographic location. As WarWire’s a company based in the United States, you cannot sign up to use WarWire if you are in a geography from which you are prohibited from doing commerce with US persons or companies.

To sign up for WarWire, we’ll need some basic personal information. Specifically, we’ll need your name, physical location, and email address. We’ll also ask you for payment information (i.e. a credit or debit card number, its expiration date, and verification number), which gets passed on to a third-party payment processor. WarWire will use the information requested at sign up to identify you when you sign in, provide you with customer support, collect monthly payments, and keep you up to date on your account and our Service.

Finally, after you sign up, a website administrator may contact you to ask you why you’re using WarWire, i.e. a use-case review. We do this in order to understand our userbase, give use-case specific tips and tricks, or to determine whether a given user or use case falls within WarWire’s terms of service. Please allow about 24 hours for this process to be completed, which will never count against your free trial usage period. (If there are any unexpected delays in setting up your account, we’re almost always happy to make up for it with a refund or free month of usage, on a case-by-case basis, of course.)

Once you sign up for WarWire and start using it, we’ll ask you some additional information. To begin, you’ll need to connect your social media accounts, through which all geographic and keyword searches will be conducted. So, we’ll redirect you to your personal social media account pages, where you have to enter your user name, password, and any other information that is required in order to authorize WarWire to conduct searches on your behalf, which is done through your personal social media accounts. This means that connected social media platforms will know who you are and what you are searching. We ask you to connect to your personal social media accounts so that you can conduct more searches faster. All of your personal social media data used to authorize WarWire searches are 1) encrypted during transmission to relevant social-media platforms, and 2) stored with a 3rd-party database provider that encrypts all database contents.

Once you’ve connected relevant social-media accounts, we’ll ask you to let us see your geographic location, as estimated by your IP address. We ask for this information so that we can give you search results that are close to you as soon as you start using the application.

To better support our user base, we may also collect Personally Identifiable Information about you from the following sources:

  1. Registration. As noted, in order to become a Subscriber (as defined in WarWire’s Terms of Service), you have to provide us the following information to create an account: name, email address, location, valid credit card that you are legally authorized to use in the purchase of goods and services, and a password. Without this minimal amount of information, you cannot create a WarWire account. Like other passwords, you should choose one that is known only by you. You acknowledge that this information is personal to you, and by creating an account on WarWire, you may allow others, including WarWire, to identify you and to allow WarWire to use your information in accordance with our Terms of Service.
  2. Additional Information. Once you become a Subscriber, you may provide additional information to WarWire related to your account, the Service, or promotions by WarWire or its affiliates. Any information you provide WarWire or any of its affiliates may be used by WarWire as described in the Terms of Service and this Privacy Policy, including for the purpose of improving the Service or directing marketing opportunities to you. If you decide not to share certain information, you may not receive the full benefit of being a Subscriber.
  3. Customer Service. We collect information when you interact with WarWire’s customer service in order to accurately categorize and respond to customer inquiries and investigate breaches of our terms.
  4. Using Third Party Services and Visiting Third Party Sites. Information you provide to third-party sites/websites through the Service is not within the control of WarWire and you provide such information at your own risk. The terms and conditions of use and the privacy policies of those websites that you provide information to through the Service will govern their use of such information. Any information you share with a third-party site through the Service will be collected by WarWire. WarWire will use such information in compliance with this Privacy Policy.
  5. Use of Cookies. Our Website may send a “cookie” to your computer. A cookie is a small piece of data that is sent to your browser from a web server and stored on your computer’s hard drive. A cookie cannot read data off your hard disk or read cookie files created by other sites. Cookies do not damage your system. Cookies allow us to recognize you as a user when you return to the WarWire website using the same computer and web browser. We use cookies to identify which areas of our site you have visited, so the next time you visit the site, those pages may be readily accessible. Most browser software can be set to reject Cookies. However, if you reject our Cookies, certain functionality on our Website may not work correctly or at all. In the course of serving advertisements or optimizing the Service to our Subscribers, we may allow authorized third parties to place or recognize a unique cookie on your browser. Any information provided to third parties through cookies will not be personally identifiable, but may provide general segment information for the enhancement of your user experience by providing more relevant advertising. WarWire does not store unencrypted personally identifiable information in the cookies
  6. Web Beacons. WarWire also may use web beacons, pixels, anonymous ad network tags, and cookies to more effectively serve ads to our Users, as well as to collect Non-Personal Information about your use of our Website and the websites of selected sponsors and advertisers, to collect anonymized, aggregated auditing, research and reporting for advertisers, and to collect data related to your use of special promotions or newsletters. The information collected by Web Beacons also allows us to statistically monitor how many people open our emails and for what purposes these actions are being taken. Our Web Beacons are not used to track your activity outside of our Website or the websites of our sponsors. We do not link Non-Personal Information from Web Beacons to Personally Identifiable Information without your permission. However, because your web browser requests advertisements and web beacons directly from ad network servers, these networks can view, edit or set their own cookies, just as if you had requested a web page from their site. If you are a non-registered Visitor to the Site, the only information we collect will be Non-Personal Information through the use of cookies or web beacons.
  7. Log files, IP Addresses and information about your computer and mobile device. Due to the communications standards on the internet, when you visit our Website we automatically receive the URL of the site from which you came and the site to which you are going when you leave WarWire’s Website. Additionally, advertisers receive the URL of the page you were on when you click on an ad on WarWire’s Website. As discussed, WarWire also receives the IP address of your computer (or the proxy server you use to access the Internet), your computer operating system and type of web browser you are using, email patterns, your mobile device (including your UDID) and mobile operating system (if you are accessing our Website using a mobile device), as well as the name of your ISP or your mobile carrier. WarWire may also receive location data passed to it from third-party services or GPS-enabled devices that you have enabled. Also, as described above in Section 2, WarWire receives information when you access third-party web pages through the Service. The link between your IP address and your personally identifiable information is not shared with third parties without your permission, except as described in Section 15. (‘Compliance with Legal Process’), below.
  8. When you use WarWire, you will create and enter search queries into our service, and view query information that has been returned to you by the Service. We may keep a record of the search queries that you have entered into the Service, but we will not maintain any record of the information returned to you by the Service. Search queries are made through the personal social-media accounts that you chose to connect to WarWire. As noted previously, this means that the third-party social media services that you search through WarWire will know who you are and what you’re searching. They’ll also know that you’re using WarWire.
  9. Exemptions from Privacy Policy. Our Privacy Policy does not apply to any information you may send to WarWire by email or instant messaging programs (i.e. AOL, Yahoo, etc.), as email and instant messages are not recognized as secure communication forms. As such, we request that you do not send any information, which you consider private, to us by email or instant message. Furthermore, our Privacy Policy does not apply to any information you post from our Software to other websites (i.e. Twitter, Facebook, etc.), due to the public nature of social-media postings
  10. Use of Personally Identifiable Information. WarWire uses and/or intends to use Personal Information to:

USER CONTROL OVER PERSONAL DATA

If you’ve signed up to use WarWire, you can make changes to your account information by logging into your account and modifying your preferences. On your end, you can also manually delete cookies, which are typically located in your temporary Internet or cookie folder (although this may affect product functionality when you access our website or services that require a log-in).
You can contact us to obtain a copy of your personal information that is held by us, and you have the right to request that we delete any and all personal data held by us. Just write us an email at admin@warwire.net.

You are responsible for ensuring the accuracy of the Personally Identifiable Information you submit to WarWire. Inaccurate information will affect your ability to access our Software, your ability to purchase other products and services from our Website, and our ability to contact you as described in this Privacy Policy (i.e. your email address should be kept current).

  1. Use of Credit Cards. You may have to provide a credit card to purchase other products and services from our Website. We use 3rd party billing services and HAVE NO CONTROL over these services. We will use our best efforts to make sure that your credit card number is kept STRICTLY CONFIDENTIAL by using only 3rd party billing services that use the latest security encryption technology to protect your credit card number from unauthorized use. However, you understand and agree that we are in no way responsible for any misuse of your credit card number by a third-party.
  2. Use By Minors Prohibited. WarWire is committed to protecting the privacy of children. Neither our Website nor our Software are designed or intended for use by individuals under the age of 18 without parental supervision. WarWire is not responsible for determining the age of its users and has no liability whatsoever if a minor uses our Website to acquire goods and/or services that would otherwise be prohibited due to the minor’s age. To that end, WarWire encourages parents and guardians to monitor their children’s Internet usage.
  3. Links/Postings to Other Websites. Our Website and/or Software may contain links to other websites. WarWire is not responsible for the actions, practices, or content of such websites linked to or from our Website and/or Software. You understand that such websites may have their own legal documents to which you must agree to prior to using and that we have no control over these legal documents. As always, you understand that it is your responsibility to verify your legal use of a website as well as use of information from the website with the corresponding website owner.

MORE ON HOW WE USE YOUR INFORMATION

  1. Market Research. From time to time WarWire’s market research department, or contractors and service providers operating on its behalf, may conduct online research surveys in order to gather feedback about our Website and opinions on important issues, through email invitations, pop-up surveys and online focus groups. When participating in a survey, we may ask you to submit Personally Identifiable Information. This Personally Identifiable Information is used for research purposes, and is not used for sales solicitations. When a third party sponsors a survey, aggregate information of the survey results is reported to the sponsor. Personally Identifiable Information collected through market research will be used only by WarWire and its service providers and contractors and will not be given or sold to a third party without your consent or as otherwise permitted by this Privacy Policy. For market research surveys we will not knowingly accept survey responses from or conduct interviews with any person under the age of 18. In addition to collecting survey responses from our members, Cookies may be used to authenticate respondents or to help you pick up where you left off in a survey. If you have Cookies disabled in your browser, you may not be able to participate in some studies. Cookies may also be used to connect survey data with our Website’s usage characteristics.
  2. When We May Disclose Your Information. Except as set forth below or as specifically agreed to by you, WarWire will not disclose any Personally Identifiable Information as gathered from you on our Website. To operate our Website, to meet your needs for a wide choice of quality products and services, and for other reasons, WarWire may share Personally Identifiable Information as described below:

We may share Personally Identifiable information in limited fashion to our contractors and service providers that perform services on our behalf, including, but not limited to, operation of our Website technology, marketing services, and other related services. Unless you have opted-out (see Section 15) of such sharing, these contractors also may have access to your email address to send newsletters or special promotions to you on our behalf or to send emails to you for purposes such as conducting market research on our behalf. Access to your Personally Identifiable Information by such contractors and service providers is limited to the information reasonably necessary for the contractor to perform its limited function for WarWire. We also contractually require that such contractors and service providers: 1) protect the privacy of your Personally Identifiable Information consistent with this Privacy Policy, and 2) not use or disclose your Personally Identifiable Information for any purpose other than providing us with products and services as required by law.
  2. We may share Personally Identifiable information we collect, as permitted by law, to companies such as credit reporting agencies, or servicing and processing companies, or when required or advised to do so in response to a valid legal requirement to release this information such as a state or federal law, regulation, search warrant, subpoena, or court order; or (2) in special cases, such as in response to a physical threat to you or others, to protect property, or defend or assert legal rights, to defend ourselves in litigation. In the event that we are legally compelled to disclose your Personally Identifiable information to a third party, we will attempt to notify you unless doing so would violate the law or court order.
  3. While your address with us is in New York, we will not share information with affiliates and third parties as described in this Section10. In addition, while your address with us is in New York, we will not share information with third parties as described in this Section, nor will we share information with financial institutions that are not our affiliates and with whom we do not have joint marketing agreements as provided in this Section.
  4. If you prefer that we do not share certain information with our contractors and service provider, as described above, you can direct us not to share that information by contacting us (admin@warwire.com).

WarWire may disclose your Personally Identifiable Information to effect a merger, acquisition, or otherwise; to support the sale or transfer of business assets; to enforce our rights or protect our property. If WarWire is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or prominent notice on our Website of any change in ownership or uses of your Personally Identifiable Information, as well as any choices you may have regarding your Personally Identifiable Information. Finally, WarWire may provide content and services to you through websites other than our own. WarWire will not disclose your Personally Identifiable Information to these 3rd party websites without your consent, but you should be aware that any information you disclose on such sites is NOT subject to this Privacy Policy.

As such, you should protect your user ID and password and NOT share it with anyone. CAN-SPAM Compliance Notice. WarWire and its affiliates fully comply with the federal CAN-SPAM Act. You can always opt out of receipt of further email correspondence from us.

  2. Transfer of Ownership. If the entire or substantial ownership of our Website were to change, your user information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises of our then current Privacy Policy.
  3. Notice to Residents of Countries outside of the United States of America. WarWire is headquartered in the United States of America. Personal Information may be accessed by us or transferred to us in the United States or to our affiliates, business partners, merchants, or service providers elsewhere in the world. By providing us with Personally Identifiable Information, you consent to this transfer. We will protect the privacy and security of Personally Identifiable Information according to our Privacy Policy, regardless of where it is processed or stored.
  4. Your Acceptance of This Privacy Policy. This is our entire Privacy Policy and it supersedes any earlier version. You agree to it every time you use our Website and/or Software. We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes to this policy may be made with or without notice. If we make material changes to this policy, we will notify you here, by means of a notice on our home page, or by email so that you may access and review the changes to this document in advance of your continued use of the service. If you object to any changes, you may close your account. By continuing to use the WarWire service after notice of changes has been sent to you or published on WarWire’s Website, you are consenting to the changes.

  5. Questions About This Privacy Policy. Should you have a privacy question about our Website and/or Software, please email our customer service department (admin@warwire.com)
